Kristin Cataldo is a managing member and co-founder of Cataldo & Fisher, LLC.  She has a general civil litigation practice, representing local and national clients in a variety of business and employment litigation matters.  Attorney Cataldo regularly litigates in federal and state courts and has handled numerous business disputes, including professional negligence claims, securities claims, contract claims, business torts, shareholder disputes, fiduciary duty claims, and adversary proceedings in bankruptcy.  She has also handled  a range employment disputes, including non-competition and solicitation agreements, confidentiality and trade secret issues, discrimination claims, and wage act violations. Attorney Cataldo has been certified by the Massachusetts Commission Against Discrimination to conduct internal discrimination complaint investigations for clients, and has mediated cases through court programs and private mediators.  Prior to founding Cataldo & Fisher, Ms. Cataldo practiced civil litigation and employment law at the firms of McCarter & English, LLP (formerly Gadsby Hannah, LLP), and Donnelly, Conroy & Gelhaar, LLP in Boston, MA.


Attorney Cataldo has been recognized as a Massachusetts Super Lawyer Rising Star in the category of Business Litigation by Boston Magazine in 2006, 2007 and 2008.


Recent cases and representative civil engagements include:


        Defended international publisher against allegations of violations of the Fair Credit Reporting

        Act, defamation and 93A.  Obtained summary judgment on all counts and summary

        affirmance by the First Circuit.  Varad v. Reed Elsevier, Inc., No. 06-11370 MLW (D. Mass.

        May 3, 2008) aff'd No. 08-1734 (1st Cir., July 6, 2009). 


        Obtained a preliminary injunction in case involving trademark infringement and unfair     
        competition. Groove Entertainment, Inc. v. GrooveBoston, LLC, No. 2011-1-A (Mass. Super.
        2011). 

        Represented national bank against allegations of fraud and violations of 93A.  Prevailed on a

        motion to enforce the settlement agreement.  Bistany v. PNC Bank, N.A., 585 F. Supp. 2d

        179 (D. Mass., 2008).  


        Defended national student loan provider in numerous lawsuits, typically involving alleged

        violations of consumer protection statutes and/or the Fair Credit Reporting Act.


        Defended national accounting firm against allegations of negligent misrepresentation and

        violations of 93A for alleged failure to adhere to applicable auditing standards.

 

        Represented employer in suit alleging handicap discrimination.  Obtained summary judgment

        on all discrimination claims.  Hooker v. Trusted Life Care, Inc. et al., No. 07-174C (Mass.

        Super. 2009).   


        Represented venture capitalist in suit alleging claims of securities law violations and fraud on

        the part of start up venture.  Resolved case through mediation.


        Represented bankruptcy trustee in adversary proceeding involving claims of fraudulent

        conveyance, preferential transfers, and breach of fiduciary duties against company's former

        officers and directors.  Successfully opposed motion to dismiss and resolved litigation

        through mediation.  Aquino v. Amadeus Capital Corp. et al., Adv. Pro. No. 04-1288 JNF
        (Bankr. D. Mass).  


        Represented international biodiesel fuel company in various lawsuits involving allegations of

        breaches of contract, fraud, conversion and unfair and deceptive business practices. 


        Represented employer against claims brought by former employee for alleged violations of the
        Massachusetts Wage Act for failure to pay commissions.


Education


Ms. Cataldo graduated from Suffolk University Law School, summa cum laude, in 2002.  While attending Suffolk, she placed first regionally, and second nationally, in a trademark Internet appellate moot court competition of sixty two law schools.  Ms. Cataldo also received several awards and honors during law school, including Jurisprudence Awards in the areas of Tax and Commercial Paper,  Distinguished Best Oral advocate and Distinguished Best Brief, and was named Who's Who of law school students in 2001.  


Professional Affiliations


Ms. Cataldo sits on the Board of Directors of the Justinian Legal Society, and is a member of the Women's Bar Association and the Boston Bar Association.  Ms. Cataldo is a volunteer attorney for the Women's Bar Foundation Elder Law Project, which provides pro bono legal services to limited income elderly in need of wills, health care proxies and durable powers of attorney.  Ms. Cataldo is also a volunteer for the Suffolk University Law School admissions committee, and has served as a judge of the American Bar Association National Appellate Advocacy Competitions in 2006, 2010 and 2011. 


Community Service


Ms. Cataldo is actively involved in her community.  She currently sits on the Zoning Board of Appeals in Reading, Massachusetts, and is a member of the Friends of Austin Preparatory School.  She is also a past member and vice president of a local charitable organization engaged in fund raising for charitable and social needs on the North Shore.  In 2009, Ms. Cataldo was a Pacesetter participant in the Jimmy Fund Boston Marathon Walk.
